Privacy Policy

Privacy Policy pursuant to Articles 13 and 14 of Regulation (EU) 2016/679

Pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (the “Regulation”), SQIM S.r.l. provides its clients, including potential clients, as well as third parties (e.g., delegates, legal representatives, etc.) acting on behalf of or representing clients, including potential ones (the “Data Subjects”), with the following information regarding the processing of their personal data (“Personal Data”).

1. Data Controller and Data Protection Officer

SQIM S.r.l., VAT No. IT 03459510123, with registered office at Via S. Francesco 62, 21020 Inarzo (VA), Italy, represented by its legal representative pro tempore, is the entity that processes the Data Subjects’ Personal Data and is therefore considered the Data Controller. As such, it is responsible for implementing appropriate organizational and technical measures to protect data in compliance with current legislation.

SQIM S.r.l. has appointed a Data Protection Officer (DPO), responsible for ensuring compliance with privacy regulations, who can be contacted regarding Personal Data processing at: contact@sqim.bio

2. Methods of Personal Data Collection

Personal Data processed by the Controller may be collected directly from the Data Subject, including through remote communication technologies used by the Controller (e.g., websites, smartphone and tablet apps, call centers, etc.).

3. Categories of Personal Data Processed

The Personal Data processed by the Controller include, but are not limited to:

i. Browsing data (e.g., IP addresses or domain names of users’ computers, request times, methods used to submit requests to the server, response status codes, operating system and browser used, logs);
ii. Identification data (e.g., name, surname, tax code, address, date and place of birth, nationality);
iii. Contact data (e.g., telephone numbers, email addresses);
iv. Profiling and marketing data (e.g., interests and preferences);
v. Other data related to the above categories.

4. Purposes and Legal Basis of Processing

Personal Data will be processed for the following purposes, where specific conditions apply:

    • Website registration and request management:
      To handle requests for registration, contact, or information material.
      Legal basis: Execution of pre-contractual or contractual measures and compliance with legal obligations.
      Note: Data provision is optional but refusal may prevent the Controller from providing the requested service.

    • Contract execution:
      To manage contractual relationships (e.g., billing, payments, complaints) and provide services through the website.
      Legal basis: Execution of contractual obligations and legal compliance.
      Note: Data provision is optional but necessary to provide the services.

    • Legal obligations, legal claims, and fraud prevention:
      To comply with legal duties, defend rights in or out of court, and prevent fraud.
      Legal basis: Legitimate interests of the Controller balanced against the rights of the Data Subject.

    • Promotions of similar services/products:
      To send promotional communications about services/products similar to those already purchased, unless objected to.
      Legal basis: Legitimate interest.
      Note: Data Subjects may object at any time for personal reasons.

    • Marketing for SQIM S.r.l. products/services:
      To send promotional communications via traditional and/or automated means, with prior consent.
      Legal basis: Consent, which is freely revocable at any time.

    • Marketing for partner products/services:
      To send third-party promotional communications via traditional and/or automated means, with prior consent.
      Legal basis: Consent, which is freely revocable at any time.

    • Profiling:
      To analyze data and purchasing behavior to send personalized marketing content, using anonymized and aggregated models.
      Legal basis: Consent, which is freely revocable at any time.
      Note: Automated decision-making producing legal or significant effects will not occur.

5. Recipients of Personal Data

Data may be disclosed to entities acting as independent controllers or processors for the purposes described above, in compliance with legal, regulatory, or EU obligations, or where legitimate interest exists.

This includes:

    • Entities involved in processing activities (e.g., IT services, marketing agencies, banks, insurance companies);

    • SQIM S.r.l. business partners;

    • Public authorities or entities to fulfill legal obligations.

Data will not be disseminated to the public.

6. Transfer of Data to Third Countries

Personal Data is stored within the EU. If necessary for the stated purposes, data may be transferred to non-EU countries that ensure adequate protection per European Commission decisions, or under appropriate safeguards such as Standard Contractual Clauses or Data Subject’s consent.

7. Data Retention Period

Personal Data will be retained only for as long as necessary to fulfill the purposes for which it was collected, considering applicable laws and industry standards. Once this period expires, data will be deleted or anonymized unless further retention is required by law or regulatory authorities (e.g., for tax and accounting purposes).

In case of legal disputes, data may be retained for up to 10 years from resolution.

8. Data Processing Methods

Processing is performed by authorized personnel using electronic tools, ensuring lawfulness, fairness, and protection of confidentiality and rights at all times.

Profiling for marketing purposes is automated and aims to study consumer behavior to optimize promotions.

9. Data Subject Rights

Data Subjects may exercise the following rights:

i. Access their Personal Data (right of access);
ii. Rectify inaccurate or incomplete data (right to rectification);
iii. Erase data under certain conditions (right to erasure);
iv. Restrict processing under certain conditions (right to restriction);
v. Receive data in a structured, commonly used format and transfer it (right to data portability);
vi. Object to processing for legitimate interests, marketing, and profiling (right to object);
vii. Withdraw consent at any time, without affecting prior lawful processing.

Consent for automated marketing (e.g., emails, SMS, calls) also applies to traditional methods. Objection to automated marketing also extends to traditional methods unless specified otherwise.

You also have the right to lodge a complaint with the Italian Data Protection Authority or the competent supervisory authority under Article 77 of the Regulation and to seek judicial remedy under Articles 78 and 79.
